Union City Man Declines Plea Deal in Hit-and-Run Death

Last summer, a well-known New Jersey jazz musician was killed in a hit-and-run accident in Jersey City. After the accident, police launched an extensive investigation that utilized security footage, license plate readers and phone records to determine the identity of the at-fault driver.

Police eventually arrested a Union City man in connection with the crime. On May 7, the suspect was arraigned on charges of vehicular homicide and leaving the scene of a fatal accident. He pleaded not guilty to both.

In doing so, the suspect turned down a plea deal that would have sentenced him to 10 years in prison, with the possibility of parole after eight. Under New Jersey law, second degree vehicular homicide carries a potential prison sentence of five to 10 years and a maximum $150,000 fine. In aggravated cases, vehicular homicide can be charged as a first degree crime, which carries a potential sentence of 10 to 20 years in prison and a $200,000 fine.

New Jersey Criminal Defense Strategies

Neither the suspect nor his criminal defense lawyer commented publicly on the decision to reject the plea deal. However, it is likely that the defense team weighed the facts and the evidence in the case and decided that taking a plea would not be in the suspect’s best interest.

New Jersey criminal defendants have a number of options for successfully resolving the charges against them. In many cases, defendants can benefit from negotiating a reduced sentence or pleading guilty to lesser charges. In other cases, though, there may be exonerating evidence or potential constitutional violations that give defendants a better chance of prevailing at trial.
