Some New Jersey traffic violations that Kafka might enjoy

For almost everyone in the Newark area, driving is necessary part of life. We may be able to rely upon trains for our regular commutes but on the weekends if we want to go fishing or take in a show there is likely to be some driving involved. A recent article highlights some of the maddening and seemingly unexplainable traffic violation and parking enforcement scenarios that can make driving even more of a hassle than it already is.

In the first case a fisherman was only trying to land a few striped bass with his son while fishing on the shore of the Hudson River when he was given a traffic violation. The man and his son had parked their car at a small nearly empty parking lot near a dock. There were not any parking restrictions listed for the lot but a sign on the road that led to the dock instructed that the road was only to be used by vehicles that are pulling boats.

So while the parking itself was not a violation, the only way the vehicle could have arrived at the lot was by violating the prohibition against vehicles that are not towing boats. In this way the man fishing from the shore received a moving violation for his parked vehicle. The judge in this case eventually reduced the charge to illegal parking so that the man, a retired police officer, would not lose any points from his license.

In another instance a New Jersey woman parked at a spot that had a two hour limit until 7:00 pm. By parking there at 6:00 pm she assumed that she would not have to worry about the two hour limit. When she tried to explain this to the judge the judge however thought that the two hour limit should still apply. The woman though was prepared with a copy of the ordinance which showed that the limit did not apply after seven o’clock. But before she had an opportunity to correct the judge, he dismissed the case because she was able to prove that the officer notes about the time she had initially parked there were inaccurate.
