Judge arrested, enters a criminal defense on hindering charges

It was likely a sad day for the Filipino-American community in the state and elsewhere. That ethnic community’s first appointed judge in New Jersey stood in a courtroom just months after her appointment, facing charges and needing a good criminal defense. She pled not guilty to charges of hindering the apprehension of a fugitive. She faces a potential 10-year sentence if convicted.

The Superior Court Judge, 41, of Woodbridge had been working in the civil division in Middlesex County, but is now suspended. One of her criminal defense attorneys said she’s innocent, and that they eagerly awaited the facts coming out. She’s accused of knowingly harboring a fugitive in her home for one hour and not calling authorities. The 41-year-old man was wanted on an armed robbery charge from a pharmacy. He allegedly threatened an employee with a tire iron, but nothing was taken and no one injured.

The charges against her are curious and currently appear to be teetering on a loose string. The one-hour period indicates this was a temporary meeting at best. There is no active hindering of any kind. For that short period of time, why wasn’t she presumed to be acting in good faith to determine the man’s situation? It’s even frankly doubtful that failing to make a phone call in that short time can support a conviction.

There’s some speculation that the fugitive is her live-in companion. If so, she can’t necessarily be faulted for not knowing that he might someday be in trouble. It may have been totally out-of-character for all we now know. Furthermore, the armed robbery charge doesn’t quite add up: most robbers don’t go in with a tire iron and leave with nothing.

Was this simply a heated argument with the pharmacist? Was he extraordinarily upset over his medication? It’s currently unknown how pernicious his actions were. But under New Jersey law, the prosecution must overcome the strong criminal defense, and prove that she knowingly tried to hinder apprehension. At this initial, early look, it appears like someone may have jumped the gun and made some tall assumptions that won’t hold up.
