‘Compassionate release’ not fully utilized, federal officials say

One of the major problems facing the criminal justice system right now is overcrowding in prisons. Union County residents have probably heard the story before; but in essence, many prisons are far beyond their 100 percent capacity, which strains staff at the prison, drains resources and gobbles up tax dollars.

Some of the inmates in prison should be locked away; some shouldn’t even be in there in the first place. But others toil away in a cell while extraordinary circumstances should make them eligible for something called a “compassionate release” — but many people in prison don’t know about it, nor do officials go to great lengths to unify and explain the rules.

Once someone is sentenced to a federal prison, that is where they stay until they are either released for parole or their sentence is complete. In 1984, a new law changed that thinking — a prisoner could be released if he or she could prove “extraordinary or compelling” circumstances in their life warranted a release. Usually, this is a medical condition (often a terminal one). But, there can be other extreme reasons that enable a prisoner to be released.

The appeal process is complicated and difficult, neither aspect of which is helped by the lack of a uniform policy governing compassionate release. Some prisons say a sick inmate requesting compassionate release must be “likely to die within 6 months,” while other prisons have longer terms. Some prisons have an efficient system for approving such appeals; others have a jumbled system that can delay an individual’s request (often to disastrous results).

The point here is that, given the lack of information available to inmates and given that prisoners have this option available to them, it is vital to consult a criminal defense attorney to discuss your unique situation.
