Freehold Cop Guilty of Shoplifting from Local Home Depot

A Freehold Police Officer has been found guilty of shoplifting.

In 2010, Darnell Esdaile, a police officer since 1996, entered a Freehold Home Depot. Esdaile was off-duty at the time. While in the store, Esdaile loaded up on laminate flooring and a mop. He attempted to leave the store twice without paying for the items, claiming he had paid for them earlier.

When his attempts were thwarted, Esdaile went to a different register and paid for the items he wanted. He then went to his vehicle and unloaded the product into his truck. Esdaile then returned to the Home Depot and attempted to take an identical set of products using the same receipt. Esdaile told the cashier that he had paid already. As he was exiting the store he was detained by Home Depot Loss Prevention.

Esdaile was found guilty of shoplifting about $500 worth of flooring and now faces up to 18 months in prison.

Shoplifting is a serious offense in the State of New Jersey, where the severity of the offense is based on the value of stolen merchandise as listed below:

Disorderly Persons: under $200
4th Degree : $200- $500
3rd Degree: $500-$75,000
2nd Degree: $75,000 and above

Penalties for shoplifting are determined by the degree of offense, where 2nd Degree offenses are prosecuted more seriously than 3rd degree offenses and so forth. Punishments may include fines and/or temporary imprisonment. First time offenses are usually prosecuted less harshly than subsequent offenses. While individual prosecution of a shoplifting offense is determined on a case by case basis and by the respective prosecutor.
